2. User Agreement & Eligibility

By using this site or our services, you represent that you are conducting business operations as a legal entity or sole proprietorship and that all information provided to us during inquiries, quotes, or onboarding is accurate and truthful.

3. SMS/Text Messaging Terms & Conditions

Omaha Payments LLC offers our clients the option to engage in mobile SMS communications for customer support and account management. By providing your phone number and checking the consent boxes on our web forms, you explicitly agree to the following provisions:

• Program Description: Mobile text messages are used strictly for 1-on-1 operational updates, including scheduling local POS system installations, delivering technical hardware troubleshooting support, and sending transactional notifications regarding your merchant account status or rate analyses.
• Message Frequency: Message frequency varies based on your ongoing support needs and interaction with our team.
• Pricing & Disclosures: Message and data rates may apply. Please check your mobile service plan details. Omaha Payments LLC does not charge a premium fee for sending text messages.
• Opt-Out Instructions: You can cancel the SMS service at any time. Just text the keyword "STOP" to 402-685-8801. After you send the SMS message "STOP" to us, we will send you a one-time confirmation SMS message to verify that you have been successfully unsubscribed. After this, you will no longer receive SMS messages from us unless you re-initiate contact.
• Customer Support: If you are experiencing issues with our messaging program or need immediate assistance, you can reply with the keyword "HELP" to 402-685-8801 or email us directly at info@omahapayments.com.
• Carrier Liability Disclaimer: Mobile carriers (including but not limited to AT&T, T-Mobile, and Verizon) are not liable for delayed or undelivered messages.

4. Limitation of Liability

Omaha Payments LLC acts as an authorized consultant and independent hardware provider. While we work diligently to ensure seamless integration with our payment processing network partners, we are not liable for direct, indirect, or incidental damages resulting from payment network outages, merchant bank processing delays, or hardware interruptions.

5. Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions.
